My car got banged up in a highway accident, will insurance pay for repairs?

Abel Adger: Yes, that guy's car insurance should pay for the repair being at fault. That is part of the property damage liability that his car insurance must cover.

Gus Leiby: In most states, yes his insurance will pay for your repairs. You could handle this by making a claim on your own insurance and they would pay for everything then ask for reimbursment from his insurance, but it works out the same in the end so there's really no reason to get your insurance company involved unless his insurance starts giving you trouble. In some states, such as Arizona, they have what is called a no-fault rule. That means that it doesn't matter who was at-fault, each insurance company pays the repairs and medical bills for their client. That would mean you have to file a claim with your insurance company.In either case, you have the right to take the car! to the repair shop of your choice and the insurance company should pay the shop directly. The insurance company might provide you with a list of recomended repair shops, but those aren't really better shops, they're just shops that agreed to give the insurance company a reduced cost to get on their list.
